Fundamental Principles of Criminal Law

Principle of No Crime and No Punishment Without Law (Nullum crimen, nulla poena sine lege)

This principle states that an action can only be punishable if it is explicitly defined as a crime by law, and penalties must also be predetermined by law. This fundamental principle ensures legal security for citizens and prevents arbitrary practices.

Principle of Individual Criminal Responsibility

Presumption of Innocence

Principle of Certainty

Crimes and punishments must be clear and definite. People should be able to know in advance which actions constitute crimes and their consequences.

Principle of Non-Retroactivity

Laws that come into effect after a crime is committed cannot be applied retroactively if they are unfavorable to the accused. However, provisions that are in favor of the accused can be applied retroactively.

Principle of Equality

Criminal law applies equally to everyone. No privileges can be granted to any individual.
