Consumer Law

Consumer Law

In the Turkish legal system, consumer law is an important branch of law that provides solutions to problems faced by consumers in goods and services markets, protects and regulates consumer rights. In Turkey, consumer rights and interests are guaranteed by various legislative regulations, primarily the Consumer Protection Law No. 6502.

Basic Principles of Consumer Law

The basic principles observed in Turkish consumer law are

Consumer Protection Principle

Protection of the consumer, who is the weaker party in consumer transactions, is essential.

Transparency Principle

Information about goods and services offered to consumers must be clear and understandable.

Information Principle

Consumers must be fully informed about goods and services.

Pro-Consumer Interpretation Principle

Ambiguous provisions in consumer transactions are interpreted in favor of the consumer.

Equal Treatment Principle

All consumers must be treated equally, without discrimination.

Consumer Transactions and Contracts

Consumer transactions and contractual regulations are of great importance in Turkish consumer law. Special provisions have been introduced in consumer contracts to protect consumers. These include various types of contracts such as distance contracts, installment sales contracts, timeshare contracts, package tour contracts, subscription contracts, and consumer credit contracts.

Defective Goods and Services

Turkish consumer law grants important rights to consumers against defective goods and services. In case of defective goods or services, consumers can exercise one of these rights:

Price reduction in proportion to the defect

Free repair

Replacement with equivalent

Resolution of Consumer Disputes

A special system has been established in Turkey for resolving consumer disputes:

  • Consumer Arbitration Committees: Mandatory application authority for disputes below a certain monetary limit
  • Consumer Courts: Authorized for disputes above the monetary limit and objections to arbitration committee decisions
  • Mediation: Optional alternative dispute resolution method in consumer disputes
